The website is intended for informational and promotional purposes. It does not itself create a client relationship, service agreement, reservation, or binding obligation for Frobaby Productions to perform services.

2. Inquiries and Bookings

Submitting an inquiry, requesting pricing, completing a form, scheduling a consultation, or communicating with us does not guarantee our availability or reserve a wedding or event date.

A date is not reserved until:

  • We confirm our availability;
  • The client and Frobaby Productions enter into a separate written service agreement; and
  • We receive any required payment or retainer identified in that agreement.

We may accept or decline an inquiry or booking request at our discretion, subject to applicable law.

3. Separate Service Agreements

Wedding and event services are governed by a separate written service agreement.

That agreement may address matters including:

  • Services and equipment provided
  • Performance times
  • Event location
  • Pricing and payment
  • Retainers
  • Cancellation or postponement
  • Client responsibilities
  • Venue requirements
  • Outdoor-event conditions
  • Noise restrictions
  • Travel

If these Terms of Use conflict with a signed service agreement, the signed service agreement will control with respect to the booked services.

Nothing on this website modifies an existing signed service agreement unless the modification is made in writing and agreed to as required by that agreement.

These Terms of Use are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles.

Any court proceeding arising solely from these Terms or the use of this website must be brought in a court of competent jurisdiction located in Honolulu, Hawaii, unless applicable law requires otherwise.

You and Frobaby Productions consent to the personal jurisdiction of those courts.

This website venue provision does not replace any valid dispute-resolution, arbitration, governing-law, or venue provision contained in a separate signed service agreement.

19. Changes to These Terms

We may update these Terms of Use to reflect changes to the website, our business practices, or legal requirements.

When we update these Terms, we will revise the effective date at the top of this page.

Updated Terms will apply to website use occurring after the revised version is posted. Changes to these website Terms will not modify an existing signed service agreement unless permitted by that agreement and applicable law.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

21. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
